GENERAL TERMS AND CONDITIONS OF THE SDG 9 ACCELERATOR PLATFORM
1. WELCOME TO THE SDG 9 ACCELERATOR PLATFORM
Our mission
The SDG 9 Accelerator Platform aims to connect all participants in the field of sustainable industrial development (public and private sectors, academia, civil society, international organizations). The platform offers diverse communication tools and solutions to all users and aims to be a digital space where users exchange quality information.
2. Agreement
Please be informed that by using, accessing and/or registering to this website and our services, you are entering into a legally binding agreement (even if you are using our Services on behalf of an institution).
a)When you use the Services of www.ods9.org and www.sdg9accelerator.org, you enter into a legally binding agreement with the United Nations Industrial Development Organization, hereinafter referred to as UNIDO
b) This “Agreement” includes these Terms & Conditions, the Privacy Policy, the Cookie Policy and other terms that will be displayed to you at the time you first use certain features, as may be amended by UNIDO from time to time. If you do not agree to this Agreement, do NOT register and do NOT access or otherwise use this website and any of our Services.
c) This Agreement applies to both registered users of our Services referred to as “Members” and unregistered users - “Visitors”. The term “User” applies to both Members and Visitors.
d) To use the Services, you agree that you must be the “Minimum Age”. “Minimum Age” means the minimum age according to your local legislation. However, the Services are not for use by anyone under the age of 14.
3. UNIDO CARES ABOUT YOUR PERSONAL DATA
When you register as a member of the SDG 9 Accelerator Platform, you give your explicit consent for collecting your personal information including its using by UNIDO within these Terms and Conditions and the separate Privacy Policy that you should read carefully.
For more details on how we protect your personal data read our Privacy Policy. UNIDO shall take all reasonable and lawful efforts to protect users’ personal information.
Upon creation of your SDG 9 Accelerator Platform account, you may choose to enter additional information providing a description of your expertise and experience or to start following other users or posting content. Providing this additional information may give you more benefits from using our Services and thus enable us to serve you more relevant content.
In addition, by using the SDG 9 Accelerator Platform you give your consent to the use of cookies in your browser. More information about cookies can be found in point 4.
4. Cookies
Cookies are small text files that are stored by your browser on your computer hard drive. The cookies used by the SDG 9 Accelerator Platform don’t store any personal data. 5. Obligations
5.1. Membership
These rights and obligations apply to all members and all types of user profiles available on the SDG 9 Accelerator Platform – personal, professional and institutional profiles of Government representatives, UNIDO, International Organizations, Civil Society, Private Sector, Academia, Development agencies.
a) Your membership profile in the SDG 9 Accelerator Platform is free.
b) To become a Member of the SDG 9 Accelerator Platform you will fill out a registration form providing UNIDO with your Personal Data (name, surname, e-mail address, and password) and will agree with these Terms & Conditions.
c) You will not create more than one personal profile on the SDG 9 Accelerator Platform and will not create a false identity on the SDG 9 Accelerator Platform.
d) You will provide accurate information on your profile and keep it updated throughout the entire duration of your membership.
e) You will not create a profile for or use the profile of anyone other than yourself without permission.
f) If the Platform administrator disables your account, you will not create another one without our permission.
g) You will not share your password or do anything else that might jeopardize the security of your profile.
h) You will not transfer your profile (including any Page) to anyone without first getting our written permission.
i) If you select a name or similar identifier for your profile or Page, we reserve the right to remove or reclaim it if we believe it is inappropriate (such as when a trademark owner complains about a username that does not closely relate to a user's actual name).
j) You agree to use the SDG 9 Accelerator Platform in a respectful manner and will not post inappropriate, inaccurate, or objectionable content.
k) If you are having an institution profile you are obliged to follow all applicable professional and institutional codes of conduct when using the SDG 9 Accelerator Platform and Services.
m) You will not send spam or other unwelcomed communications to others.
n) You will not act in an unlawful, libellous, abusive, obscene, discriminatory or otherwise objectionable manner.
o) You will not post any unsolicited or unauthorized advertising, “junk mail”, “spam”, “chain letters”, “pyramid schemes” or any other form of solicitation unauthorized by UNIDO.
p) You agree that UNIDO reserves the right to transfer its rights and obligations with respect to users partially or completely to a third party.
You have the right to terminate this Agreement at any time in accordance with p. 9 Termination of this Agreement.
You are responsible and liable for all information, content and actions connected to your profile. If you suspect that someone is trying to jeopardize your profile, you are obliged to inform UNIDO immediately through [email protected].
Profiles of government representatives undergo a verification process by UNIDO. However, UNIDO cannot guarantee the identity of all profiles using the Platform. You are liable for damages caused if you claim a government representative, UNIDO, International Organizations or Development agency profile without having the right to do so.
5.2 Notices, Service Messages and Advertisement
You agree that we may provide notices to you in the following ways: (1) a banner notice on the Platform, or (2) an email sent to an address you provided, or (3) suggested posts on the Platform, (4) through other means including mobile number, telephone, or mail. You agree to keep your contact information up to date.
To control and limit what kind of messages you receive from us per e-mail, please review your profile settings.
5.3. Messages and Sharing
Our Services allow messaging and sharing of information in many ways, such as your profile, content (articles, status posts, comments, galleries, shares) and internal messaging. Information and content that you share or post may be seen by other Members or, if public, by Visitors. Where there are settings provided, UNIDO will honour the choices you make about who can see content or information. Please note that some Services are by default private and only visible to the addressee(s).
UNIDO is not obligated to publish any information or content on our Platform and can remove it in sole discretion, with or without notice.
5.4. Safety
UNIDO aims to keep its Platform safe but cannot guarantee it. Users are obliged to help in keeping the SDG 9 Accelerator Platform safe to the best of their ability:
a) You will try to keep your profile safe: (1) try to choose a strong and secure password; (2) keep your password secure and confidential; (3) report any suspicions that someone has or is trying to get access to your profile; (4) report any suspicions that someone is or is trying to jeopardize the safety on the SDG 9 Accelerator Platform.
b) You will not post unauthorized commercial communications (such as spam) on the SDG 9 Accelerator Platform.
c) You will not collect users' content or information, or otherwise access the SDG 9 Accelerator Platform, using automated means (such as harvesting bots, robots, spiders, or scrapers) without UNIDO’s explicit consent.
d) You will not engage in unlawful marketing, such as a pyramid scheme, on the SDG 9 Accelerator Platform.
e) You will not post anything that contains software viruses, worms or any other harmful code.
f) You will not solicit login information or access a profile belonging to someone else.
g) You will not harass, abuse or harm other Users.
h) You will not use the SDG 9 Accelerator Platform to do anything unlawful, misleading, malicious, or discriminatory.
i) You will not do anything that could disable, overburden, or impair the proper working or appearance of the SDG 9 Accelerator Platform, such as a denial of service, attack or interference with page rendering or other SDG 9 Accelerator Platform functionality.
j) You will not engage in “farming”, “mirroring” or otherwise simulating the appearance or function of the Platform.
k) You will not (1) imply or state that you are affiliated with UNIDO; (2) rent, lease, loan, trade, sell access to the Platform or related data; (3) or monetize UNIDO Services or any other feature of the Platform without UNIDO’s explicit consent.
l) You will not deep-link to our Services for any purpose other than to promote your profile or Page on the SDG 9 Accelerator Platform, without UNIDO’s explicit consent.
m) You will not facilitate or encourage any violations of this Statement or our policies.
5.5.Protecting other User’s rights
Users are obliged to respect and protect other SDG 9 Accelerator Platform users’ rights:
a) You will not post content or take any action on the SDG 9 Accelerator Platform that infringes or violates someone else’s rights or otherwise violates the law.
b) You will not copy or use information, content or data of other users available on the SDG 9 Accelerator Platform if you do not have explicit consent.
c) You will not remove any copyright, trademark or other proprietary rights notices contained in content on the SDG 9 Accelerator Platform.
d) You will not disclose information that you do not have the right to disclose, violate intellectual property or other rights of UNIDO or other people, institutions or companies without their explicit consent.
5.6. Intellectual Property Rights
UNIDO reserves all Intellectual Property rights on the Platform (including logos and other trademarks, service marks, graphics or registered trademarks of UNIDO, technical or intellectual know-how):
a) You will not use UNIDO’s copyrights or trademarks or any confusingly similar marks, except with our prior explicit written consent.
b) You will not copy or use information, content or data on the SDG 9 Accelerator Platform except with our prior explicit written consent.
c) You will not copy, modify or create derivative works of the SDG 9 Accelerator Platform, the Services or any related technology except with our prior explicit written consent.
d) You will not do reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the Platform or any related technology or any part thereof.
e) You will not remove any UNIDO copyright, trademark or other proprietary rights notices contained in or on our Platform or content within the Platform.
6. Rights and Limits
6.1. Sharing your content on the SDG 9 Accelerator Platform
As between you and UNIDO, you own the content and information that you post to the SDG 9 Accelerator Platform and you control who sees your content using the targeting options when publishing information (e.g. articles, status updates, events, contact information). You are only granting UNIDO a non-exclusive license for a worldwide, transferable and sublicensable right to use, copy, modify, distribute, publish, and process, information and content that you provide through UNIDO’s Platform, without any further consent, notice and/or compensation to you or others. These rights are limited as follows:
a) You can end this license for specific content by deleting such content from the SDG 9 Accelerator Platform, or generally by closing your profile in the SDG 9 Accelerator Platform, except (a) to the extent you shared it with others as part of the Platform and they copied or stored it and (b) for the reasonable time it takes to remove from backup and other systems.
b) UNIDO will not include your content in advertisements for the products and services of others (including sponsored content) to others without your separate consent.
c) UNIDO will get your consent if UNIDO wants to give others the right to publish your content beyond the Platform. However, other Users may access and share your content and information, consistent with the visibility you have given your content on the SDG 9 Accelerator Platform.
d) While UNIDO may edit and make formatting changes to your content (such as translating it, modifying the size, layout or file type or removing metadata), UNIDO will not modify the meaning of your expression.
In order to keep content in the SDG 9 Accelerator Platform relevant to Users and in accordance with applicable law, you agree to the following terms:
a) UNIDO may access, store and use any information that you provide in accordance with these Terms and Conditions.
b) The SDG 9 Accelerator Platform is a sustainable industrial development social media and content on it should be related to sustainable industrial development topics only.
c) Only provide content or information if it does not violate the law nor anyone's rights (e.g., without violating any intellectual property rights or breaching a contract).
d) You also agree that your profile information will be truthful. UNIDO may be required by law to restrict and/or remove certain information or content from the Platform.
e) By submitting suggestions or other feedback regarding our Services to UNIDO ([email protected]), you agree that UNIDO can use and share (but does not have to) such feedback for any purpose without compensation to you.
6.2. Other Content
By using the SDG 9 Accelerator Platform, you may encounter content or information that might be inaccurate, incomplete, delayed, misleading, illegal, offensive or otherwise harmful. UNIDO generally does not review content provided by our users. You agree that we are not responsible for third parties' (including other users') content or information or for any damages as result of your use of or reliance on it.
6.3. Limits
UNIDO has the right to change, suspend or end any service. UNIDO is not obliged to store, maintain or provide you with a copy of any content or information that you or others have posted on its Platform.
UNIDO reserves the right to limit your use of the Platform, including the number of your contacts and your ability to contact other Members. UNIDO reserves the right to restrict, suspend, or terminate your profile if UNIDO believes that you may be in breach of this Agreement or law or are misusing the Platform.
7. Disclaimer and Limit of Liability
Access to the information, documents, products and services contained in this website is provided as a public service by the United Nations Industrial Development Organization (UNIDO). The information presented does not necessarily reflect the views of UNIDO or of the governments of UNIDO Member States and as such is not an official record.
All information available from this website is provided on an "as is" and "as available" basis. UNIDO makes no warranties, either express or implied, concerning the accuracy, completeness, reliability, or suitability of the information. Neither does it warrant that use of the information is free of any claims of copyright infringement. WE ARE PROVIDING THE SDG 9 ACCELERATOR PLATFORM ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SDG 9 ACCELERATOR PLATFORM WILL ALWAYS BE SAFE, SECURE OR ERROR-FREE OR THAT THE SDG 9 ACCELERATOR PLATFORM WILL ALWAYS FUNCTION WITHOUT DISRUPTIONS, DELAYS OR IMPERFECTIONS. OFFENSIVE OR DEFAMATORY STATEMENTS, DOWN TIME OR LOSS, USE OR CHANGES TO YOUR INFORMATION OR CONTENT).
APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
8. Amendments
UNIDO will notify you before we make changes to these terms and allow you to review and comment on the revised terms before continuing to use our Services. If you do not agree to these changes, you must stop using the Platform and terminate your Membership in accordance with p. 9 Termination.
Your continued use of the SDG 9 Accelerator Platform, following notice of the changes to our terms, policies or guidelines, constitutes your acceptance of our amended terms, policies or guidelines.
9. Termination
9.1. Termination by you
You may terminate this Agreement at any time simply by stopping to use our Services and/or terminate your account by sending an email to [email protected]. On termination, you lose the right to access or use the Platform.
9.2. Termination by UNIDO
UNIDO may terminate this Agreement by sending an email to you in the following cases:
a) If UNIDO stops operating the Platform.
b) If UNIDO believes you provide untruthful information on your profile or in your content, or that you are below the “Minimum Age” to use the Platform.
c) If UNIDO believes you are violating your Membership obligations.
d) If UNIDO believes you are violating other people’s rights or jeopardizing the safety of the SDG 9 Accelerator Platform or others.
e) If you violate these Terms and Conditions in any other way.
9.3. The following may not be affected by the termination:
a) Our rights to use and disclose your feedback;
b) Users rights to further re-share content and information you shared through the Platform to the extent copied or re-shared prior to termination;
c) Points 6, 9 and 10 of this Agreement.
10. Dispute Resolution
a) Any dispute with regard to these Terms and Conditions shall be amicably solved and the Parties will use their best efforts to settle promptly such dispute through direct negotiation.
b) If anyone brings a claim against UNIDO related to your actions, content or information on the SDG 9 Accelerator Platform, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.
